Will Obama have enough votes in the Senate? 54 Democrats. 45 Republicans. 1 Ind. So According to the Constitution they need a 2/3 vote to approve a new treaty. That would be 75 votes to say yes. That would amount to. all 54 Democrats saying yes 21 Republicans saying yes. A hard sell to say the least. However the Pres could just sign an executive order and make it law? I would not put the idea past him to just by fiat decree it into being.
